A Tentative Agreement Was Reached, To End Prison Stikes

From Gov. Kathy Hochul: “My top priority is the safety of all New Yorkers, and for the past 11 days, I have deployed every possible State resource to protect the well-being of correction officers, the incarcerated population and local communities across New York. Working with a mediator, we have reached a consent award to address many of the concerns raised by correction officers, put DOCCS back on the path to safe operations, respect the rights of incarcerated individuals and prevent future unsanctioned work stoppages. I have the utmost respect and gratitude for the correction officers, civilian DOCCS employees, National Guard personnel and other staff who have done their absolute best to maintain order in our correctional facilities during this challenging period.”

Presser Today About Local Road Funding

New York State Senator Tom O’Mara (R,C-Big Flats), Assemblyman Phil Palmesano (R,C-Corning), Assemblyman Chris Friend (R,C-Big Flats) and Assemblyman Joe Sempolinski (R,C-Olean) will be joined by regional officials (the Elmira and Hornell mayors) to call on Governor Kathy Hochul and the leaders of the State Legislature to enact a stronger state commitment to local roads, bridges, and culverts in the final 2025-2026 New York State budget.

The legislators and local roads leaders have scheduled a news conference on Friday, February 28, 2025 at 2:00 p.m. at the Big Flats Town Municipal Campus, Town Highway Garage (476 Maple Street).

Chief among the group’s concerns is the ongoing deterioration of local roads, bridges, and culverts regionally and statewide. Numerous studies over the past decade have highlighted the decline of New York’s locally maintained transportation infrastructure and its impact on economic development, local property taxes, and motorist safety. Local roads advocates are also highlighting New York State’s lack of response to the impact of inflation-driven, skyrocketing construction and maintenance costs putting a severe strain on the budgets of already overburdened county and town highway departments.

Fire In The Town Of Bath Yesterday Afternoon

The Bath Volunteer Fire Department was dispatched at 4:13 pm Thursday February 20th for a structure fire at 5964 County Route 11 in the Town of Bath. The caller reported not seeing any flames, but the house was filled with smoke. Bath Chief Mike Fiordo arrived on scene to find a small fire around the chimney area of a double wide mobile home. Hazardous road conditions from an ice storm just prior slowed the response of the apparatus. As the first engine arrived on scene the fire had grown and spread into the attic space and continued to travel. Chief Fiordo then requested an engine from Thurston to setup a fill site, tankers from Savona, Campbell and Kanona, and Hammondsport Rescue with manpower. An engine from Painted Post was also requested to the scene and then later to standby at the Bath station. Bath Volunteer Ambulance was on scene in case of any injury and rehab.
Interior crews went inside to battle the blaze and were able to hold the fire to half of the home with minor smoke damage through the other half. Fire crews were able to save many of the owner’s valuable items. There were 2 people at home at the time and their animals, but they all escaped without harm. The American Red Cross was contacted to assist the family.
The fire was determined to have started in the area of the chimney. The Bath Volunteer Fire Department thanks all the mutual aid companies who responded in the frigid weather conditions as well as the Bath Fire ladies auxiliary (Fireflies), who came to the station to make coffee and hot water for hot chocolate. The last Bath unit was back in service at 7:22 pm.

The Reason Why The County Is Filing An Appeal

Yesterday afternoon we reported that the Steuben County Legislature had voted in executive session on January 27, not to appeal the Steuben County Judge’s decision from November, to restore Sheriff Jim Allard’s indemnification and insurance.  We also reported that even though the county voted not to file an appeal, and that the county was going to appeal the judge’s decision anyway.

Now we can tell you why this is happening.  County Manager Kelly Fitzpatrick says, it’s because the county’s outside counsel says that because former County Legislative Chair Scott Van Etten was named in the lawsuit and because Van Etten wants to pursue the appeal, the outside counsel says the county legislature has an obligation to defend Van Etten legally, since Van Etten is named in the Sheriff’s litigation.

The county lawmakers who voted to appeal the ruling are: Scott Van Etten, Brian Schu, Bob Nichols, James Kuhl, Wendy Lozo, Gary Swackhamer, Fred Potter and Mike Hanna.  The county lawmakers who voted against appealing the lawsuit are: Kelly Fitzpatrick, Paul Van Caeseele, Hilda Lando, Carol Ferratella, Jeff Horton, Shannon Logdson, William Thew, Joe Tobia and Nick Pelham.

Governor Using State Police At Prisons Where There Are Strikes, The Governor Might Send In The Nat'l Guard Too

Governor Kathy Hochul is planning to send the national guard in to Elmira Correctional where the prison guards have been on strike.  This will happen today, the governor says, if the strikes do not come to an end.

Also, from NYSP:  The New York State Police are assisting the New York State Department of Corrections and Community Supervision (NYSDOCCS) by providing outer perimeter security at select correctional facilities experiencing job action strikes or increased staff absences.   Since Monday evening, NYSP personnel have been deployed to several facilities to maintain a presence on facility grounds, ensuring DOCCS staff can focus their efforts on interior security operations.  At this time, the NYSP role remains limited to external security support.

Republican Response To The Prison Strike Situation

Video Message From Congressman Nick Langworthy:

Statement From State Senator George Borrello:

“What does Governor Hochul’s tone-deaf press release reveal? It shows she either doesn’t get it or simply doesn’t care about the real issues our correctional staff are facing. This isn’t about money. This is about the lack of safety and egregious violations of labor protections that every other employer in the state must follow.

Hochul's shameful silence on the deplorable conditions in our state's prisons speaks volumes. The state employees, including correctional officers, whom she is obligated to protect, face daily dangers due to conditions intentionally imposed by a radical far-left legislature and her own administration. Instead of stepping up as the leader she claims to be and responding to the reasonable concerns of corrections officers, she has chosen to deploy the New York National Guard as a strike-busting force-a move that’s as cowardly as it is ineffective.

By deploying the National Guard, she’s not only dismissing the officers’ legitimate concerns but also sets a dangerous precedent for handling labor disputes in our state. Correctional officers are on the front lines, working under incredibly challenging conditions, and their strike is a desperate cry for help, highlighting the urgent need for better working conditions and adequate staffing. By choosing to threaten and intimidate those who are standing up for their rights and safety, the Governor fails to address the root causes of the strike. Deploying the National Guard is a heavy-handed tactic, not a solution. Her actions show that she’s more interested in punishing those fighting for a safer workplace than in actually solving the crisis at hand.”

Corning Man Pleaded Guilty in Federal Court

FROM THE US ATTORNEY'S OFFICE:

U.S. Attorney Trini E. Ross announced today that Ryan M. Newman, 33, of Corning, NY, pleaded guilty to production of child pornography before U.S. District Judge Meredith A. Vacca. As a convicted sex offender at the time of his crimes, Newman faces an enhanced minimum penalty of 25 years in prison, of maximum penalty of 50 years, and a $250,000 fine.

Assistant U.S. Attorney Kyle P. Rossi, who is handling the case, stated that Newman was convicted of child pornography crimes by New York State in 2012, sentenced to serve a local jail term and 10 years’ probation, and required to register as a Level 3 Sex Offender, which is someone considered to be at high risk of re-offending and a threat to public safety.

In January 2021, the National Center for Missing and Exploited Children (NCMEC) received a report from Snapchat that a user had uploaded a video of child pornography. NCMEC sent the tip to the New York State Police, who executed a search warrant on Newman’s person and residence in 2022. The search determined that Newman uploaded the child pornography video to Snapchat and possessed other child pornography on his electronic devices. Newman remained out of custody following the 2022 search warrant by the State Police. In April 2024, the FBI Corning received a tip that pornography involving a child in the Corning area, was distributed to an undercover agent in Illinois. Subsequent investigation determined that Newman sexually abused the child and produced the child pornography. Newman was taken into custody by the FBI and Corning Police.

Newman is also charged in Steuben County Court.

The plea is the result of an investigation by the Federal Bureau of Investigation, Corning Office, under the direction of Special Agent-in-Charge Matthew Miraglia, and the Corning Police Department, under the direction of Chief Kenzie Spaulding.

Sentencing is scheduled for  June 11, 2025, at 10:00 a.m. before Judge Vacca.

Attention Farmers: You'll Want To Read This One

Agriculture and Markets Law Section 303-b was enacted to provide for the designation of an annual 30-day period during which landowners may submit requests for inclusion of predominately viable agricultural land into an existing certified agricultural district.  Steuben County has designated February 15 through March 17, 2025 as this 30-day period.  The Steuben County Planning Department encourages farmers to enroll their land in an Agricultural District by March 17, 2025

Agricultural property owners may request inclusion of viable agricultural land not already included in a certified NYS Agricultural District.  The property owner must demonstrate that the agricultural land is viable or actively farmed.  The property owner must also supply the owner name and tax map number of the property.  Only whole parcels are eligible for inclusion.  Owner name, tax map number, and agricultural status of the property may be emailed to Planning@SteubenCountyNY.gov or, preferably, this form may be obtained here:

https://www.steubencountyny.gov/DocumentCenter/View/810/Agricultural-District-303b-Addition-Request-Form-PDF?bidId= and sent to the address on the form.

Requests will be reviewed by the Steuben County Agriculture & Farmland Protection Board, after which time, the Board will request a public hearing and approval by the Steuben County Legislature.  Once approved by the County Legislature, the proposal is forwarded to New York State Agriculture and Markets for certification.

The purpose of agricultural districting is to encourage the continued use of farmland for agricultural production.  Detailed information about Agricultural Districts may be found here:

https://www.steubencountyny.gov/DocumentCenter/View/811/Agricultural-Districts-FAQ-PDF?bidId=

If you have any questions about enrolling in an agricultural district contact the Steuben County Planning Department, 3 East Pulteney Square, Bath, NY 14810, (607) 664-2268, or email Planning@SteubenCountyNY.gov

Assemblyman Phil Palmesano (R,C-Corning) is reminding people of the 2nd annual Student Art Contest hosted by Donate Life New York State. In celebration of Donate Life Month, students are encouraged to share their donation stories and perspectives on organ donations through art. Submissions must be in by Feb. 28 and winners will be notified by March 21. Entries must be submitted by a teacher or parent and must include the participating student’s name, grade level, age, address, phone number and email. There are four separate categories for the contest, elementary, fourth and fifth grades; middle school, sixth through eighth grades; and high school, ninth and tenth grades and eleventh and twelfth grades.

Artwork will be hung throughout the Legislative Office Building during Donate Life Month in April. Winners will receive a $100 gift card and will be recognized at a press conference to be held on April 8 in Albany. For more information on this opportunity, please see the link here

“Organ donation is a cause near and dear to my heart, so I am always happy to help promote this important issue however I can. According to Donate Life New York, our state ranks 47th out of 52 registries of states and territories in the country in total organ donor enrollment. We have a 50% enrollment rate while the national average is 64%. As a state, we have the third-greatest need for organs but the sixth-worst enrollment rate. We can, and must, do better. I hope this art contest will help spread the word about the importance of organ donation. If you have already registered to become an organ donor, thank you. If you have not, please talk to your family and consider it as you can help save the lives of your fellow New Yorkers. In fact, one person who donates at their time of death can save up to eight lives and impact the lives of 75 others. To register to donate, visit your local DMV or visit the NYS Donate Life Registry website today,” said Palmesano.

Lack Of Volunteers And Other Factors Caused Dissolution

The Steuben County Village of Hammondsport Volunteer Ambulance Department is in the process of shutting down.  we asked Steuben County Manager Jack Wheeler why things are harder these days, for volunteers in this line of work.  The county manager says, one big issue these days for volunteer ambulance crews is a lack of new volunteers to take the place of those who are aging. "Many of the volunteer agencies face the problem of new volunteers coming up," he explained.

"Then too, there is the nature of people's jobs," Wheeler said. "Things just aren't as flexible so that employees can leave for an emergency."   Wheeler also says, another problem in recruiting volunteers is the  excessive number of training hours being imposed on volunteers, thanks to new regulations.
